Prop 8 Declared Unconsitutional, California Ban on Gay Marriage Overturned

Prop 8 has been declared unconstitutional.
Excellent news! The 9th US Circuit Court of Appeals has ruled that California’s ban on gay marriage, known as Prop 8, “violates the constitution,” Reuters reports. They add, the case “is likely to lead to a showdown on the issue in the U.S. Supreme Court.”
Prop 8 was approved by 52 percent of California voters in 2008 and “amended the state’s constitution to limit marriage to a man and a woman,” the Washington Post reports. The 9th Circuit Court’s decision upheld a 2010 decision by former Judge R. Vaughn Walker, who said that Prop 8 “fails to advance any rational basis in singling out gay men and lesbians for denial of a marriage license.” Walker is a gay man, a fact that the panel of 9th Circuit judges found inconsequential. According to the AP, “The panel said there was no evidence that former Chief U.S. Judge Vaughn Walker was biased and should have disclosed before he issued his decision that he was gay and in a long-term relationship with another man.”
The AP also notes that it is “unclear when gay marriages might resume in California.”
