Michael Yavorski, a Pennsylvania ice cream vendor, is worried his three-month sentence for fondling a 12 year-old girl could ruin his business.  In fact, says his lawyer, Scott Wilhelm, the ice cream stand in Lower Nazereth Township could close for good because of the negative spotlight.

Wilhelm requested a hearing for a reduced sentenced, and argued that “The collateral consequences for Mr. Yavorski here are tremendous.” Yavorski was recently sentenced to the three months (plus a year of probation) after admitting to misdemeanor charges of indecent assault and furnishing alcohol to a minor.  The charges stem from a day in the summer of 2006 in which he fondled a girl and and her beer.

Wilhelm, however, in asking for a reduced sentence, argued that there was only one incident, and pointed out that psychological reports stated that Yavorski is a good candidate for community supervision.

The girl, now 15, spoke at Yavorski’s sentencing in early October.  She said she has suffered from the effects of the assualt, and has been hospitatlized five times since, and taken to cutting herself.  And while Emil Giordano, the judge ruling on the reconsideration request, has not yet issued a ruling, he made his general sentiments clear.

When Wilhelm aruged that Yavorski wasn’t a sex offender, since the crimes he admitted to don’t trigger Megan’s Law sex offender registration, Giordano stated that, “He is a sex offender. There’s no doubt about it.“  He added that Yavorski’s actions were “deplorable,” and said “If I didn’t make that clear on the record the first time, I’ll make it clear this time.”

Meanwhile, Assistant District Attorney James Augustine was not swayed by Wilhelm’s request for leniency.  If anything, he argued, the jail time should be longer, and he asked Giordano to extend it, rather than reduce it.

Uhhhh yeah, I hope his business does suffer… or close! And he should have to walk around with a sign that lights up and screams “SEX OFFENDER” on his forehead!

You touch little kids, people don’t want to give you their business. That’s the way it goes. The damage for the girl he molested is far worse.

Comments I am confused.How is this a controversy?He should suffer and lose his business.Maybe selling ice cream is the wrong line of work for a pedophile.

Obviously this guy is f-d in the head, because getting a child drunk and touching her sexually is disgusting. I also wonder how this douche-bag lawyer sleeps at night.
