Got Breastmilk? The State of California Sues
Don’t mess with California or their Milk Advisory Board. The state of California has filed a lawsuit against the Texas Sticker company for using their “Got Milk” trademark for their Got Breastmilk spin off stickers. In the past the Milk Advisory Board has licensed their phrase to for profit companies for T-shirts, stickers and merch. But they have no such deal with the company in Texas who created and are selling these stickers.
The state is alleging, “false designation of origin, and trademark infringement and dilution.” They want Texas Sticker to stop using the logo immediately and “destroy or surrender all the stickers bearing the breastmilk

Laure68 commented on Sep 04 09 at 3:34 pmThis really doesn’t have to do with breastmilk, per se, but with the fact that this company did not have the legal right to use this phrase, especially since they are making money off of these stickers. Why wouldn’t the Milk Advisory Board sue?

“Got Breastmilk?” is a parody of “Got Milk” and falls under the first amendment rights.
