14-year-olds Charged as Adults in Locker Room Assault Case

locker room 300x200 14 year olds Charged as Adults in Locker Room Assault CaseFour boys from Tampa, Florida may spend the rest of their lives behind bars for what they probably thought was a locker room prank.

But their 13-year-old victim certainly doesn’t see it as a prank.

The teens are accused of repeatedly sodomizing the victim with a broomstick and hockey stick. The assaults continued for two months. Despite the victim’s screams and numerous witnesses, no one came forward to report the crimes.

In fact, the alleged attacks only came to light when the victim was questioned about another incident, a fight on a football field. After revealing the attacks, his four accused attackers each gave written statements to the school, in which they all confessed to sexually assaulting the victim.

Now they are being charged as adults with four counts each of sexual battery. They could be sentenced to 120 years in prison if convicted on all counts.

This is clearly a horrifying story, made all the more so by the fact that so many students must have heard or seen the attacks and no one alerted authorities. I can’t even imagine the shame and fear the victim must have felt that made him keep silent.

But do you think the boys should be charged as adults? What they did was atrocious, but should you really be punished for the rest of your life for decisions you made at 14? Yes, they were stupid and cruel and vicious. But should they go to jail for the rest of their lives? Does the fact that they did this at 14 mean they’re any more likely to do it again when they’re 21?

I don’t know the answer. When I think about this happening to one of my own sons, it makes me sick to my stomach. And I would most certainly want his attackers to pay. But what price?

Keri, I’d be curious to know where you get the idea that sodomizing someone was “probably” thought by the perpetrators to be a prank? I have no firm opinion on minors being tried as adults, but I’m sure that most of us have heard the citation of evidence that juveniles who hurt animals are more likely than those who don’t to grow up to hurt people. I tend to think that maybe this isn’t a whole lot different. For whatever reason these boys committed this act — it was a “prank,” or they were just malicious — this is a pretty big deal, and quite possibly indicative of a much deeper pathology.

Reason #585 for homeshooling your kids.

for sure, they need to be tried as adults… behavior like this will only continue into their actually adulthood… get them now before they do it again!

I am normally on the side of trying children as children, adults as adults. This might make me change my mind, if only for a minute. The thought of this happening to my own son… What I would want isn’t appropriate in print.
I think I have heard that you cannot rehabilitate a sex offender. These boys are sex offenders. A prank happens once. That makes me think this is more than a prank. If you really thought you were doing a prank and it sounded funny in your head but then when you did it you realized it was sick don’t you think you wouldn’t repeat it? You would only repeat it if you were a sick freak.
Lock them up and throw away the key!

What. The. Hell. Seriously, Keri? A prank? They probably thought repeatedly sodomizing a child with a hockey stick and a broom was A PRANK?? That is no prank and they damn well know it. It is RAPE and if they spend the rest of their lives in prison I won’t shed any tears for them. They gang-raped another child. I just can’t begin to wrap my head around why you would think they figured it was just a harmless prank, tee-hee, kids will be kids.

There is also a HUGE difference between a “decision you made when you were 14″ such as shoplifting a pack of gum and something you did over and over and over, for months on end. That isn’t a decision, that’s sustained pathological behavior. That’s the sort of behavior that should earn them a lifetime stay in a place where they won’t be able to hurt any other children.

Now I have to go lay down for awhile. A prank, indeed.

They repeatedly raped this boy in front of witnesses over a period of months. I am going to bet that those witnesses were also subject to threats and/or violence. If these boys could do this, God only know what else they have done and what else they could be capable of.

If these attacks occurred in school, for months, in the presence of witnesses, I’d say these two boys aren’t the only ones who should be tried for the crimes. I cannot believe that teachers – particularly the gym teacher – were completely unaware that anal rape-by-stick was taking place repeatedly in the effing *locker room*.

Try the juvenile perps as adults, and try the witnesses and teachers who should reasonably be believed to have had some knowledge of the attacks as accomplices/aiding-abetting. Jesus Christ.

Upon further reflection on this post, and after my initial comment, I realized that I was way too lenient. The fact that they repeatedly did this, as a gang, with instruments? I’d like to repeat everything Knitty just wrote.

ChiLaura commented on Jun 20 09 at 6:09 pm

Throw away the key. We have enough rapists running around free. Would anyone be so willing to be lenient if the victim was a elderly woman or a little girl?

Ali commented on Jun 20 09 at 8:53 pm

Repeated gang rape is “probably considered a prank”? What kind of sick world do you live in?

karmamama commented on Jun 21 09 at 10:25 am

My thoughts exactly Ali. Or indeed, any girl. If the victim had been a girl would it have been a prank? Sexual assault is the exact term. That poor kid. I hope that the ones who were silent on this reflect on what their silence cost that kid.

Marj commented on Jun 21 09 at 11:01 pm

How the eff is this a prank? (Warning: survivor of childhood sexual assault speaking; this does color my opinion and I know it) This was repetative sexual torture. Sure, they’re 14. Do they get to get out at 18 and do it all over again?

I am of the firm opinion that sex offenders, especially those who victimize children, should have very limited rights in society, because a child’s right to a normal childhood sure as $hit trumps their “rights”.
They should be tried as adults. And futher – is “someone” looking into why the eff these 14 year olds were acting in such a manner?

PlumbLucky commented on Jun 22 09 at 8:19 am

Wow, this entire situation is completely horrifying, and it turns my stomach just to think about it.

But… They’re still 14. Counseling might get somewhere with them. Rehabilitation might be possible. Are we so willing to give up on human beings, on adolescents, just because what they did disturbs us so much? That’s an impulse for revenge, and it has no place in juvenile justice. There’s a reason kids aren’t tried as adults: they have fewer resources for decision-making, and a much greater capacity to change. This should be handled as a very serious offense, obviously, but that doesn’t have to mean “try them as adults.”

“Four boys from Tampa, Florida may spend the rest of their lives behind bars for what they probably thought was a locker room prank.”

It’s kind of horrifying that you would open your post like this. There is no way that rape is EVER a prank. I can only imagine the nightmare of being repeatedly sodomized by those objects at the age of 13. I am in complete agreement with the others here who believe these kids should do some serious time. I also agree that the school is partially to blame. Kids should not be so unsupervised that repeated assaults of this kind can go unnoticed by school staff.

Manjari commented on Jun 22 09 at 1:55 pm

Zanne, maybe they could babysit your kids. These kids are sexual molesters, and rehabilitation is not likely as most molesters go on to do it again once freed. And Keri, you should be ashamed of yourself, what if this was your child???? Really.

Sheri commented on Jun 22 09 at 11:40 pm

This kids need to be locked up as adults and get treated like that in the prison shower room.. Along with registering for life.. Hell everyone in the United States needs to be registered, damn nasty pervs..

“…..what they probably thought was a locker room prank.”

Jesus. You can’t be serious.

Ramming a broomstick or hockey stick up a screaming boy’s anus while they hold him down is a prank?

They didn’t think it was a prank any more than their screaming and struggling victim.

“After revealing the attacks, his four accused attackers each gave written statements to the school, in which they all confessed to sexually assaulting the victim.”

Probably hoping for some undeserved leniency.

“Yes, they were stupid and cruel and vicious.”

Just cruel and vicious.

“Does the fact that they did this at 14 mean they’re any more likely to do it again when they’re 21?”

Yes:

They didn’t wait ’til they were 18 to commit rape again, and again, and……….”The teens are accused of repeatedly sodomizing the victim with a broomstick and hockey stick. The assaults continued for two months.”

They’d still be doing it to him or someone else if they hadn’t been charged.

“I don’t know the answer.”

Wise up and read what they did again and again. The victims screams didn’t cost them a second thought. Letting them away with it is asking for more of the same.

They are already serial rapists and gang rapists, and you think they should get a slap on the wrist?

Cassandra commented on Oct 13 09 at 6:12 am

I would say 7 years in prison, 5 with good behavior (completing their HS Diploma will be dependent on that along with behavioral markers they must meet) as well as some sort of restitution. $250,000.00 from each offender should be just. This along with all psychiatric evaluation and treatment being covered by the school district.

I should be a judge.
