Elizabeth Smart Trial Set To Start Again
Brian David Mitchell, the man accused of kidnapping Elizabeth Smart, wil be put back on trial. The three-judge panel vacated the temporary stay it issued Thursday, which halted the trial just after the defense had begun its opening statements in a Salt Lake City federal courtroom and asked for a mistrial so that proceedings could be moved to another city.
Brian is arguing an insanity defense. Elizabeth, her mother and her sister will all take the stand against him.
Elizabeth was kidnapped in 2005 and held for four months a a campsite. She was dressed in a robe, wed to David and raped. She was found walking down the street of a Salt Lake City suburb with Brian, a self described prophet, and his wife, Wanda Eileen Barzee. He was charged with six felony counts of kidnapping, sexual assault and burglary but a judge ruled him incompetent to stand trial and sent him to the loony bin.
In 2008 a grand jury indicted Brain and a judge found him competent to stand trial Let’s hope he is put away for a long time.

Lacee commented on Nov 05 10 at 5:37 pmYou people need to get your facts straight before you post your articles. Elizabeth was kidnapped on June 5, 2002 and was held captive for nine months. She spent 4 months at a campsite before her kidnappers took her to California, where she stayed until March 2003. In March 2003 she and her kidnappers returned to Utah, where she was rescued by the police.
