Jon has just filed papers asking for primary custody as well as a review of the child support order that is in place. He’s stated that Kate has abused the terms of the custody agreement by failing to document child support payments.

Original: With Kate busy with Dancing With The Stars, Jon Gosselin is making plans to file an emergency petition for primary physical custody of his kids!

Jon has said that even when Kate is home a nanny does all the work.  He’ll need a stronger reason than that though.  Being a single mom with 8 kids, you’d be crazy not to hire help if you can afford it.

His new lawyer Anthony F. List (yes, that’s his real name) tells TMZ that Kate is “an absentee mom,” and that DWTS keeps her from spending “quality time” with her children.

Jon is also going to seek other changes.

He currently pays $22,000 a month in child support and is looking to change the arrangement so that Kate pays him. The amount he is seeking is unspecified.

Jon is still under contract with TLC and can’t make or profit from any public appearances that aren’t authorized by the network, so he could argue he is having trouble making a living-he does, however, currently live in a $5,000 apartment in New York City, so he obviously has some savings.
