Newsweek ran a cover photo of Sarah Palin in tiny running shorts to illustrate a story about how her politics are polarizing.  Palin says the picture was completely out of context, if not out of character for Newsweek.

Sarah said on her Facebook:

“The choice of photo for the cover of this week’s Newsweek is unfortunate. When it comes to Sarah Palin, this “news” magazine has relished focusing on the irrelevant rather than the relevant. The Runner’s World magazine one-page profile for which this photo was taken was all about health and fitness – a subject to which I am devoted and which is critically important to this nation. The out-of-context Newsweek approach is sexist and oh-so-expected by now. If anyone can learn anything from it: it shows why you shouldn’t judge a book by its cover, gender, or color of skin. The media will do anything to draw attention – even if out of context.”

Yes, she responded on Facebook. Welcome to politics and news in 2009.

The bigger problem with the cover photo may be that it wasn’t Newsweek’s picture to print.

The picture was actually shot by photographer Brian Adams for Runner’s World and was published this past August. The photos were under embargo for a year, and Palin insists that she didn’t give Newsweek permission to print them, nor did Runner’s World.

“Runner’s World did not provide Newsweek with its cover image. It was provided to Newsweek by the photographer’s stock agency, without Runner’s World’s knowledge or permission.” Newsweek has confirmed that they purchased the photo through a third party stock agency and claims to have no prior knowledge of any possible issues with using the pictures.

Presumably, a national media outlet has dealt with the concept of copyright and photo rights before.
